§ A5-3. [Governing body designated; powers of district.]

  • The board of county commissioners of Marion County, Florida, shall constitute the district board of said community or municipal service district and shall constitute the governing board of said district and shall act for and on behalf of said district as a body corporate and politic. Such district shall be a body corporate and politic, exercising essential governmental functions and shall have the power to sue and be sued; to contract; to adopt and use a common seal and alter the same at pleasure; to purchase, hold, lease, or otherwise acquire and convey such real property and personal property and interests therein as may be necessary or proper to carry out the purposes of this law. The clerk of the circuit court of Marion County, Florida, shall be ex officio the clerk and treasurer of the district.
