§ 10-129. Insurance.

  • No certificate or permit holder(s) shall operate an emergency vehicle covered under this article unless covered by a comprehensive general liability insurance policy, insuring the public against bodily injury or property damage resulting from or incidental to the operation or use of an emergency vehicle. At a minimum, all certificate and permit holder(s) shall have in full force and affect the following insurance coverages:

    (1)

    Motor vehicle liability insurance. Each emergency vehicle owned by, leased to, or otherwise used or controlled by the certificate or permit holder(s) shall have minimum limits of one million dollars ($1,000,000.00) combined single limits for bodily injury and property damage.

    (2)

    Medical professional liability insurance. Every certificate or permit holder(s) shall have minimum limits of one million dollars ($1,000,000.00) per occurrence/three million dollars ($3,000,000.00) annual aggregate coverage.

    The foregoing insurance policies must inure to the benefit of any person who shall be injured or killed, or who shall sustain damage to property proximately caused by the negligent or intentional acts or omissions of the certificate or permit holder(s), all drivers, servants and agents. Nothing in this section shall be construed to waive applicable state or federal laws, if any, which may require a higher amount of minimum insurance. Evidence of the foregoing coverages is subject to acceptance and approval by the Marion County Risk Management Office prior to the issuance of a certificate.

    The foregoing insurance coverages must remain in full force during the entire time that the certificate or permit is valid and outstanding. Failure to provide such proof shall render the certificate or permit null and void, and of no further use and effect.

    (3)

    No public liability. The issuance of a certificate or permit by the county does not create any partnership or joint venture between Marion County government or any of its agencies and the certificate holder. The certificate or permit holder(s) shall not be deemed to be an agency of Marion County, and shall not enjoy any protection of the county's sovereign immunity, or its limited waiver of sovereign immunity under F.S. § 768.28. The certificate or permit holder(s) shall not be covered under any county self-insurance or policy of insurance.
