§ 11-97. Appeals.

  • (a)

    Any party to the proceedings before the board may appeal a final order of the board to the Circuit Court of the Fifth Judicial Circuit. Such an appeal shall not be a hearing de novo, but shall be limited to appellate review of the record created before the board. An appeal shall be filed within thirty (30) days of the date of the written order appealed from.

    (b)

    The record in cases heard by the board shall consist of:

    (1)

    All notices;

    (2)

    Evidence received or considered;

    (3)

    Objections or rulings thereon;

    (4)

    Any written submissions not constituting evidence;

    (5)

    The board's findings; and

    (6)

    The official transcript.
