§ 16-11. Prohibited acts.

  • (a)

    Solid waste shall not be discarded, deposited, or disposed of at any location in the county, except a recycling center, the baseline landfill, or a solid waste management facility that is authorized by applicable law to receive such material. However, this chapter shall not prohibit any person from disposing of their own solid waste on their own property in compliance with applicable law.

    (b)

    No person shall cause litter in violation of the Florida Litter Law, section 403.413, Florida Statutes, or article III of this chapter. If litter is released or falls from a person's motor vehicle for any reason, the person shall immediately stop the

    motor vehicle and remove the litter from any public property or property owned by another person.

    (c)

    If a person's solid waste is spilled, released, or carried onto public property or the property of another person by the wind, animals, or other causes, the owner of the solid waste shall immediately collect and remove their solid waste. If a person's solid waste is spilled or released from the person's collection container, the person shall immediately collect and remove their solid waste from any public property and any property owned by another person.

    (d)

    No person shall remove any solid waste or other material that has been set out by another person for collection by a franchise holder.

    (e)

    Hazardous waste shall not be placed in a collection container and set out for collection by a franchise holder.

    (f)

    Hazardous waste shall not be delivered to or disposed of at a recycling center or the baseline landfill, unless the delivery and disposal of such material is authorized in advance by the director.

    (g)

    Solid waste shall not be burned on public or private property; provided, however, that: (1) yard trash may be burned when appropriate permits are obtained and the burning is conducted in compliance with applicable law; and (2) other types of solid waste may be burned when authorized by the board by resolution.

    (h)

    Solid waste generated or collected outside of the boundaries of the county shall not be delivered to or disposed of at a recycling center or the baseline landfill, unless authorized in advance by the board.

    (i)

    No person shall place solid waste in a collection container owned by another person, unless the owner of the collection container has given their prior approval for its use.
