§ 16-24. General conditions for franchises.

(a)

A franchise holder shall comply at all times with this article, any rules or regulations adopted by the board pursuant to this article, and all applicable laws.

(b)

A franchise holder shall, at its sole expense, obtain and at all times maintain the local, state, and federal licenses, certificates, permits, and other authorizations that are necessary to conduct the franchise holder's operations.

(c)

A franchise granted pursuant to this article shall be non-exclusive — i.e., the franchise shall authorize the franchise holder to operate throughout the county.

(d)

A franchise holder is an independent contractor; a franchise holder is not an agent, servant, or employee of the county. This article specifies certain work to be done by a franchise holder, but the method, manner, and means to be employed to accomplish this work shall be the sole responsibility of the franchise holder.
