§ 16-37. Solid waste must be covered in collection vehicles.

  • (a)

    Each vehicle used by a franchise holder to transport solid waste shall fully enclose the franchise holder's load. A vehicle shall have a fully enclosed metal top, a tarpaulin, or a net cover with mesh openings not greater than one and one-half (1½) inches in size. The top, tarpaulin, or cover shall be kept in good working condition and shall be free from tears and holes. The cover shall be used to fully enclose the franchise holder's load at all times when the vehicle's speed exceeds twenty (20) miles per hour and at other times when necessary to prevent the franchise holder's load from blowing out of the vehicle. All loads must be fully enclosed from the place where the solid waste is collected to the place at the solid waste management facility where the solid waste is unloaded. Placing a tarpaulin on the load at the entrance of a solid waste management facility shall not constitute compliance with the requirements of this section. The use of ropes, chains, or cords to secure a load, without a tarpaulin or net, shall not constitute compliance with this section.

    (b)

    A franchise holder transporting solid waste in violation of the requirements of subsection (a), above, shall be charged a tripping fee of fifty dollars ($50.00) per ton at the baseline landfill. This fee shall be in addition to the tipping fee charged for the type of solid waste contained in the franchise holder's load. The total tipping fee will be the sum of the two (2) rates. Three (3) or more violations of this requirement shall be considered a major violation of the franchise and may subject the franchise holder to a suspension or revocation of the franchise in accordance with subsection 16-51(d), below. Any franchise holder violating subsection (a) shall be reported to the county code enforcement board for prosecution.
