§ 16-38. Franchise holder's collection containers.

  • (a)

    A franchise holder may provide collection containers to a customer or the customer may obtain collection containers from another source.

    (b)

    The director may prohibit the use of any collection container that is found to be unsuitable or undersized.

    (c)

    A franchise holder shall label its dumpsters and other mechanical containers with letters or numbers at least four (4) inches high. The labels shall be placed on at least two (2) sides of each mechanical container. At least one of the labels shall be readily visible when the mechanical container is placed at a customer's site. The labels shall provide the contractor's name, telephone number, and identification number for the mechanical container.

    (d)

    A franchise holder shall handle a customer's collection containers with reasonable care and shall return the containers to the approximate location where they were set out by the customer. A franchise holder shall immediately clean up any solid waste it spills when collecting or transporting solid waste in the county.

    (e)

    Any collection container damaged by a franchise holder shall be repaired or replaced by the franchise holder within seven (7) calendar days after the franchise holder receives notice of the damage. The collection container shall be repaired or replaced within one business day if the director notifies the franchise holder that immediate action is necessary to prevent a nuisance or an imminent threat to the public health, safety, or welfare.
