§ 16-63. Set out procedures for customers.
(a)
The procedures and requirements established in this section shall be followed by all customers. However, a franchise holder shall collect a customer's solid waste, even if the customer fails to comply with one or more of the requirements in this section, unless the director determines in advance that collection service may be suspended or terminated for that customer.
(1)
Garbage and putrescible waste shall not be collected, stored, or set out in an open, uncovered box, bag, or collection container.
(2)
Customers shall not overfill a collection container. The lid, if any, on a collection container shall be closed securely after solid waste is placed in the collection container.
(3)
Collection containers shall be placed in locations that are readily accessible to the customer and the franchise holder's vehicles.
(4)
A customer shall not place solid waste in another person's collection container, unless the customer has received the other person's prior approval.
(5)
A customer shall not set out commercial waste for collection as residential waste.
(6)
A customer shall not set out solid waste for collection on property that is not owned or occupied by the customer, unless the customer has received the prior approval of the owner or occupant of such property.
(b)
Customers that receive residential collection service shall comply with the following procedures:
(1)
A customer shall use curbside containers and/or heavy-duty plastic bags to set out garbage and rubbish for collection. A curbside container or heavy-duty plastic bag shall not exceed fifty (50) pounds in weight when filled.
(2)
Each curbside container shall: (i) be constructed so as to prevent intrusion by water and animals, and the expulsion of its contents; (ii) have a cover that is free from sharp edges; and (iii) not have inside structures that prevent the free discharge of the container's contents.
(3)
A customer shall place its collection containers at curbside no earlier than 4:00 p.m. on the day preceding the collection service. The customer shall remove the collection containers from the curbside within thirty-six (36) hours after the customer's solid waste has been removed by the franchise holder.
(c)
Customers that receive commercial collection service shall comply with the following requirements:
(1)
Commercial customers shall place their garbage and rubbish in a dumpster or other mechanical container. The director may authorize the commercial customer to set out garbage and rubbish in a roll cart, curbside container, or other collection container where efficiency or other circumstances justify.
(2)
Commercial customers shall not place construction and demolition debris with any other type of solid waste in a collection container.
