§ 19-92. Violations.
(a)
Whenever a User has violated or continues to violate any provision of this article, a wastewater discharge permit, or order issued hereunder, or any other pretreatment standard or requirement, water service to the User may be severed. Service will only recommence, at the User's expense, after it has satisfactorily demonstrated its ability to comply.
(b)
Each day or portion thereof a violation continues shall constitute a separate violation.
(c)
The Administrator may suspend the wastewater treatment service and a wastewater discharge permit when such suspension is necessary, in the opinion of the Administrator, in order to stop an actual or threatened discharge which presents, or may present, an eminent or substantial endangerment to the health or welfare of persons, or to the environment, or which may cause interference with the operation of the WWF, or which may cause the utility to violate any conditions of its permits.
(d)
Any person notified of a suspension of the wastewater treatment service or the wastewater discharge permit shall immediately stop or eliminate the discharge. In the event of a failure of the person to comply voluntarily with the suspension order, the WWF shall take steps as necessary, including immediate severance of the sewer connection, to prevent or minimize damage to the treatment plant and any endangerment to individuals. The utility shall reinstate the wastewater discharge permit or the wastewater treatment service upon proof of the elimination of the non-complying discharge. A detailed written statement submitted by the user describing the causes of the harmful contribution and the measures taken to prevent any future occurrence shall be submitted to the utility within fifteen (15) days of the date of occurrence.
(e)
In the event the violation results in damage to the WWF, the violator shall pay any costs incurred by the WWF in repairing such damage, including incidental costs, prior to reinstatement of service.
