§ 19-126. Term of permits.

  • (a)

    Each water and wastewater permit shall be valid for a period of twelve (12) months from the date of issuance and the validity thereof may be extended for additional successive periods by payment of any applicable "guaranteed revenue charge" for each twelve-month extension, provided any such fee must be paid before the permit expires. If the permit expires, the right to any water and/or wastewater service capacity for the use of which a building permit has not been issued (or if issued, has expired) shall terminate. The permittee may reapply for the unused service capacity and receive a credit for any water and/or wastewater capital charges previously paid upon issuance of a new permit. Any permit may be revoked by the county for violation of or noncompliance with provisions of the permit or this article, mistake of fact, or mistake of law. All capital charges paid pursuant to the county's rate ordinance shall, upon issuance of the permit therefor, be nonrefundable unless the county determines that a hardship to the permittee exists and the county and the permittee mutually agree that, for good reason, the permit be canceled and all water and/or wastewater capital charges be refunded; provided, that no permittee may be entitled to any interest on any such charges paid to the county, whether refunded or not.

    (b)

    If the permittee is unable to use all of any portion of the water and/or wastewater service capacity allocated pursuant to the permit, the permittee may, prior to the termination of the right to such capacity, request in writing to sell such surplus capacity back to the county. The county shall buy such surplus capacity back from the permittee at the rate per ERC originally paid by the permittee for such service capacity. The county may defer the purchase thereof until it has identified another qualified customer or customers ready, willing, and able to pay the capital charges for and to use the surplus capacity being released by the permittee.
