§ 19-143. Conflicts; collection of special assessments; intent.

  • Nothing contained herein is intended to conflict with any special assessment ordinances and resolutions adopted by the county, the terms of which shall control over any conflicting language in this division. Consistent with any county ordinance or resolution related to special assessments, the county is authorized to collect and owners of lots shall pay appropriate assessments for any property which was subject to but has not yet paid assessments. This right of collection and obligation to pay shall include, but is not limited to those instances where a restrictive covenant has been breached or waived and the owner or its successor is seeking to develop property previously exempt from the assessment by virtue of the existence of the restrictive covenant.
