§ 2-38. Bond or other security.

  • (a)

    Required . The board shall secure public officials liability insurance, as well as crime insurance to secure the faithful performance of the duties of his or her office, in the amount of one million dollars ($1,000,000.00) per claim as to the following county officers which insurance coverage shall be in lieu of a fidelity bond:

    County commissioners

    Property appraiser

    Tax collector

    Clerk of the circuit court

    (b)

    Sheriff and deputy sheriffs .

    (1)

    The sheriff shall give bond, conditioned upon the faithful performance of the duties of his or her office in the amount of ten thousand dollars ($10,000.00).

    (2)

    Deputy sheriffs. Each lawfully appointed deputy sheriff shall give bond, conditioned upon the faithful performance of the duties of his or her office, in the amount set by ordinance. The board of county commissioners may accept a blanket surety bond issued by a solvent surety company authorized to do business in this state, conditioned upon the faithful performance of the duties of the deputy sheriffs appointed by the sheriff.

    (c)

    Approval . Each bond required by this section shall be approved by the board of county commissioners and filed with the clerk of circuit court.

    (d)

    Duty of board of county commissioners . The board of county commissioners shall, at its regular meetings in January and June of each year, examine carefully as to the sufficiency of bonds of the sheriff and his or her deputies, and if it has reason to believe that the sufficiency of any bond has become impaired, it shall at once require the officer to execute and file with the proper office a new bond for the same amount and under the same conditions as his or her former bond.
