§ 2-201. Definitions.

  • The following words and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context otherwise requires:

    Board or board of county commissioners shall mean the board of county commissioners of Marion County, Florida.

    Code enforcement board shall mean the code enforcement board of Marion County, Florida.

    Code inspector shall mean any authorized agent or employee of the county, whose duty it is to assure compliance with the codes and ordinances of the county.

    County shall mean Marion County, Florida.

    Local governing body attorney shall mean the legal counselor for Marion County, Florida.

    County ordinances shall mean all ordinances adopted by the board of county commissioners pursuant to the authority of section 125.01(1)(t), Florida Statutes and section 1, article VIII of the State Constitution including all ordinances codified pursuant to section 125.68, Florida Statutes.

    Order shall mean an order issued by the code enforcement board or special magistrate.

    Public records shall mean the public records of the county.

    Repeat violation shall mean a violation of a provision of a code or ordinance by a person who has been previously found through a code enforcement board, special magistrate or any other quasi-judicial or judicial process, to have violated or who has admitted violating the same provision within five (5) years prior to the violation, notwithstanding the violations occur at different locations.

    Sheriff shall mean the sheriff of the county or his duly appointed deputy.

    Special magistrate shall mean a special magistrate designated by the board of county commissioners, who is a member in good standing of the Florida Bar, and who may be assigned to hear and decide alleged violations of Marion County ordinances, in lieu of the code enforcement board. Selection and compensation for the special magistrates shall be established by resolution of the board of county commissioners and pursuant to a contract approved by the board of county commissioners.
