§ 3-2. Hours of sale.

  • (a)

    Generally. It shall be unlawful for any person to sell, consume or serve, or permit to be sold, consumed or served, any alcoholic beverages in any establishment licensed by the state division of alcoholic beverages and tobacco except during the hours specified below:

    (1)

    On Mondays through Saturdays, from 7:00 a.m. through 2:00 a.m. of the following day.

    (2)

    On Sundays, as follows:

    a.

    With meals in restaurants and clubs which comply with Rule 7A-3.0141 of the state division of alcoholic beverages and tobacco between 1:30 p.m. and 9:30 p.m. The term "meal," as used in this clause shall have the meaning assigned to it in Rule 7A-3.0141 of the state division of alcoholic beverages and tobacco.

    b.

    Notwithstanding clause a., when December 31 (New Year's Eve) falls on a Sunday, between 1:00 p.m. Sunday and 2:00 a.m. of the following Monday.

    c.

    Notwithstanding clauses a. and b., beer, wine and ale may be sold between 7:00 a.m. Sunday and 2:00 a.m. of the following day; i.e., Monday.

    (b)

    Bottle clubs. Bottle clubs shall be open only during the hours permitted in subsection (a). It is unlawful for any person, or his agents, servants or employees to open a bottle club at any other time or to permit a bottle club to remain open at any other time. This subsection shall not apply to any religious, charitable or fraternal organization operated not for profit.
