§ 5-52. Food or alcoholic and nonalcoholic beverages in disposable containers.

  • (a)

    The possession of food or alcoholic or nonalcoholic beverages on Rainbow River in disposable containers shall be unlawful. Paper sacks, boxes, breakable plastic utensils, paper napkins and towels are prohibited on Rainbow River.

    (b)

    A violation of this section shall be punishable by a fine of fifty dollars ($50.00).

    (c)

    Citations issued for violations of this section shall identify the next available county court criminal arraignment date and shall provide that no appearance is required if the fine is paid either by mail or in person before the arraignment date. If paid before the arraignment date, the fifty-dollar fine will be inclusive of fees and costs.

    (d)

    If the fine is not paid before the arraignment date, the violation shall be prosecuted in the same manner as a misdemeanor and a court appearance shall be required on the specified date.

    (e)

    If the person to whom the citation is issued does not contest the violation in court, or if the county is the prevailing party, the court shall assess a filing fee of ten dollars ($10.00) and court costs against the person or non-prevailing party.
