§ 4.3.23. Non-conforming structures.

  • Where a lawful structure exists at the effective date of adoption or amendment of this Code that could not be built under the terms of this Code by reason of restrictions on area, lot coverage, height, yards, setbacks, or other characteristics of the structure or its location on the lot, such structures may be continued so long as they remain otherwise lawful, subject to the following provisions:

    A.

    Such structures may be enlarged or altered provided the enlargement and alteration meets the requirements of this Code and does not increase the non-conformity.

    B.

    Such structures existing as of the adoption of this Code, shall be permitted to be rebuilt and repaired in the event of destruction or damage by accident, fire, flood, explosion, collapse, wind, war or other catastrophe, provided the reconstruction does not increase the gross density or intensity of the property, shall meet other applicable codes, and does not increase the non-conformity.

    C.

    Should such structure be moved for any reason for any distance whatever, it shall be required to conform to the regulations for the zoning classification and overlay zone in which it is located after it is moved.
