§ 16-7. The county's solid waste management facilities.
(a)
The county owns and operates various solid waste management facilities for the benefit of the county's residents. However, the public's right to use the county's solid waste management facilities is subject to the limitations contained in this article and applicable law.
(b)
The board may designate, by resolution, the types and quantities of solid waste that may be disposed of in the county's baseline landfill, the recycling centers, and the county's other solid waste management facilities.
(c)
Any person delivering solid waste to one of the county's solid waste management facility shall dispose of only those types of solid waste that have been approved by the board for disposal at that facility. The county employees at a solid waste management facility shall only accept those types of solid waste that have been approved by the board.
(d)
An owner or occupant of residential property may use the recycling centers for the disposal of the garbage, rubbish, and recyclable materials that the person generates on their residential property as a result of their normal housekeeping activities, if the current solid waste assessment for such property has been paid to the county.
(e)
Yard trash may be delivered to the county's solid waste management facilities, subject to the requirements in section 16-9, below.
(f)
A resident of the county may dispose of passenger vehicle tires or small truck tires at the baseline landfill. However, tires shall not be accepted at the recycling centers.
(g)
A person shall not dispose of commercial waste or agricultural waste at a recycling center or in a collection container owned by the county.
(h)
A franchise holder shall not dispose of any solid waste at a recycling center. A franchise holder also shall not dispose of any solid waste at any other solid waste management facility that the county has designated for use only by the residents of the county.
(i)
Any person seeking access to the county's solid waste management facilities may be required to demonstrate that the person is a resident of Marion County before the person is allowed to use the county's facilities. Proof of residency may be demonstrated with a current and valid voter registration card, property tax documents, or a drivers license.
(j)
The county may regulate traffic at, and restrict admittance to, the county's solid waste management facilities. Any person violating the county's regulations may be denied admittance to the county's solid waste management facilities or prosecuted pursuant to applicable law. Any person using the county's solid waste management facilities shall comply with the posted traffic signs and any instructions given by county staff concerning the use of the facilities.
(k)
The director shall establish normal hours of operation at each solid waste management facility. No person shall dispose of solid waste at a county solid waste management facility except during the normal hours of operation or when authorized by the director.
(l)
No person shall remove, scavenge, or rummage through any solid waste, recyclable materials, or recovered materials at the county's solid waste management facilities, except a person that has received the director's prior written approval to recycle or process such material.
