§ 19-134. Developer's agreements required.
Prior to the water and/or wastewater plan approval by the county and the execution of system extension applications by the county, the applicant may be required to execute a developer's agreement. This agreement shall be binding upon the applicant, its successors and assigns for the original property in need of service, and may in the sole discretion of the board of county commissioners, be for a term in excess of the term provided for in section 19-126 applicable to permits. Such developer's agreements may not be assigned or subdivided into parcels and/or lots. Execution of developers' agreements shall be in lieu of the optional permitting allocation process established by section 19-123 of these rules so long as the county determines prior to execution of any such agreement that it has or will have adequate capacity to implement such agreement.
